PURCHASE AGREEMENT FOR OUR SERVICES

1. PERSONAL DETAILS

Gite e Viaggi is a brand of the Tripaca agency of Ma.Ste.R. Srls is located in 00183 Rome, Piazza Epiro, 17a, shared capital € 100,000 therefore referred to as TL, has produced a set of tools such as the website www.tripacalink.com - www.giteeviaggi.com and its customer area reserved for users who choose to register, IYSP co-branded sites (Increase Your Sales Programme) and mobile applications defined as Booking Tool, which allow customers to book tour and travel services and/or tour and/or transport packages public.

 

These General Conditions form an integral part of each contract with Customers who wish to use TL for the booking and planning of the transport services offered. These customers, after having made the reservation and received confirmation from TL, acquire the right to use the services purchased, including transport services which will be performed independently by the Carrier. 

 

2. LEGAL RELATIONSHIPS

TL is only responsible for the activity required for the reservation and planning of the purchased service. The subsequent rendering of this service involves a direct relationship between the Client and TL. In fact, on the basis of the Price List attached to the Contract with TL, the Customer decides to request the service, including all the conditions and the relative price, and communicates them to TL in accordance with the contractual terms. Indeed, upon confirmation of receipt of a reservation by the Client, the Client-Carrier Agreements terminate, which are legally terminated in the contract referred to in Article 1218 of the Civil Code (Travel agency contract).

 

3. USE OF THE TOOL

How customers use the tool is defined in these terms and conditions signed by TL and depends on the agreed options. The completeness and accuracy of the information and all subsequent changes included in the booking forms, or otherwise provided by the Client to TL, are the sole responsibility of the Client. TL will only send Carrers the information provided by the Client at the time of booking. TL is not responsible for any errors or omissions made by the Client in completing the Booking Form.

 

4. LIABILITY

5. PROTECTION OF PRIVATE INDUSTRIAL RIGHTS

The tools provided to customers, including all their content, are the exclusive property of TL, which fully honors the intellectual and commercial exploitation rights. The tools are not provided to the customer for exclusive use. In no event may a Customer claim any rights to the Tool other than those which are due to the Customer under the contract with TL. A customer is prohibited from: (i) copying, benchmarking or reverse engineering the tool; (Ii) transfer the Tool to a third party, temporarily or permanently, directly or indirectly; (Ii) transfer the Tools to a third party; (Iii) make the Tool a use other than that contractually provided. TL reserves the right to modify, replace or withdraw at any time - at its sole discretion - all Tools in use, or each of them, with a notice of 15 (fifteen days) to be communicated by e-mail. In this case, TL will not affect the customers' operations. TL guarantees its customers any claim from third parties regarding the use of tools and technologies with non-proprietary technology.

 

6. SELECTED TRANSPORT SERVICE INFORMATION

The passenger transport service by means of cars, vans or tour buses is provided to customers, or users or passengers by the carriers, who are responsible for having an appropriate permit issued by the municipal authority for each of their cars. The TTL of the transport services, the classes, the range of cars available, the routes, routes and tours, the relative prices, the terms and conditions of the transport services are described in lists attached to each individual contract signed by TL with customers and / or in the form of a reservation on the site. Customers can choose the service they book on behalf of their users by consulting the lists.

 

6.1 RESERVATIONS

Correct booking and acceptance of any subsequent changes are conditioned by the availability of the courier. Carrier availability is communicated to a Customer via the Tool and is only confirmed upon receipt of such electronic communication. At the time of booking, the Client must specify any optional or extra services requested; The extra services are described in the listing and/or booking form together with their cost.

 

6.2 INFORMATION ON THE NUMBER OF PASSENGERS ON BOARD

The maximum number of passengers allowed on board may vary according to the type and class of car booked; Generally the number of passengers on board varies: from 1 to 3 for cars, from 4 to 8 for vans and from 9 to 72 for tourist buses.

 

6.3 CHANGES, DELAYS AND CANCELLATION OF BOOKING - NO SHOW

- GROUP DAY TRIPS:

a) Reservation changes, including cancellation, must be notified by a client to TL within 72 hours of service;

b) if the cancellation is made within 72 hours of the service, the customer does not incur any penalty; if the cancellation occurs for less than 72 hours from the service, TL is required to keep the payment received and the customer to pay the full price of the ticket of the package/s and/or of/the services/o (No show);

c) in the event that the Passenger does not show up at the meeting point at the agreed time of the service, the following waiting times are observed: 10 minutes in the departure stalls, 5 minutes in the passenger's residence. If the passenger is not present beyond the terms mentioned above, he will still be penalized. If the passenger fails to give notice after the free waiting time, the penalty will apply as in the case of a No show;

d) in the case of excursions, tours and trips for which the booking is subject to the imminent purchase of skip-the-line tickets such as trains, planes, entrance to museums and/or attractions or maritime transport, the booking is penalized at the time of confirmation exclusively for the amount of the ticket purchased by TL ( penalty considered 50% );

e) waiting times at airports, railway stations and ports are affected by possible transport delays upon arrival. Therefore, the passenger appointment time will be changed accordingly by shifting the start of the transportation service to a passenger. In any case, applicable penalties for delay and no show above;

f) in the case of booking a service beyond 72 hours, the automatic penalty of No Show is attributed, unless otherwise agreed.

- OTHER TYPES OF SERVICES, PACKAGES, MULTIDAY TOURS, ETC:

follows logic and cancellation policy identified in the contract of each specific product and reported before the act of confirmation.

 

7 TRANSFER SECURITY

 

7.1 PASSENGERS, LUGGAGE AND ANIMALS ON BOARD

 

The carrier is solely responsible for the number of passengers, animals and baggage allowed on board. Therefore, the Carrier may refuse to accept passengers and baggage on board that exceed those booked or in compliance with the applicable safety regulations. With regard to animals, the Carrier may refuse to accept animals on board that are not included in the reservation.

7.2 TRANSPORT OF CHILDREN

Child seats must be requested at the time of booking. If such information has not been provided, the Carrier may refuse to admit children on board to protect the safety of passengers.

 

7.3 CONDUCT ON BOARD

The passenger must observe, for the entire duration of the transport, the rules of the road code and those on transport safety. Therefore, the passenger must wear a seat belt, avoid opening the car doors while driving and avoid throwing objects from the windows. It also shouldn't protrude from the windows. It is forbidden to smoke, drink alcohol and consume food on board.

 

8 PRICES AND PAYMENTS

 

8.1 PRICES (TARIFFS)

The prices or tariffs correspond to the class of vehicle selected, the time, duration, distance of the transport booked and the optional or extra services requested. All related information is detailed in the lists attached to the contracts and/or booking form. These prices are inclusive of the TL fee due for your booking and scheduling services. Extra services not required by the reservation will be set separately as required by the TL - Client contracts. Prices include VAT due by law. TL reserves the right to modify the price lists and anything else contained therein (services, prices, etc.) at its discretion. The changes will be applicable from the first day of the month following the notification of the changes.

 

8.2 METHOD OF PAYMENT

Payment for services is made online. Any fees for the management of payment cards must be considered included in the price. In case of specific agreements with customers, it may also be possible to pay on board or after the services. Unpaid payments require a guarantee for support.

 

8.3 PAYMENT LATE

TL reserves the right to charge interest on any late payment at the maximum rate of 7% per annum from the date a payment was due to an effective credit date.

 

9 CONFIDENTIAL INFORMATION

All the information contained in contracts, annexes, reports and documents exchanged between the parties and commercial, legal, administrative, financial matters of which the parties become aware by virtue of their contractual relationship are considered strictly confidential and it is therefore forbidden for TL and the Customer disclose to third parties directly or indirectly.

 

10 CONTENT AND JURISDICTION

The customer acknowledges that TL is solely responsible for the reservation, planning and service of transportation in the terms described in Section 4 of the General Conditions. The law governing the contract between TL and the Customer, including the General Terms and Conditions, is the Italian law which prevails over other languages ​​in the event that translation is required. In the event of a dispute relating to the interpretation and/or application of the contract between TL and the Customer, including the General Conditions, the jurisdiction of the Court of Appeal is the exclusive responsibility of the Court of Rome.
